POLICY AND TERMS
| 1. Reservations may be made on the Internet, by mail, e-mail, fax, phone, or in person. A deposit must be paid by Visa, MasterCard or check to confirm your reservation. A Reservation Confirmation and this Policies and Terms will be mailed to you detailing cost, dates and policies. Please sign and return the Reservation Confirmation to confirm your reservations. The balance of your rental amount is due (30) days prior to check in. Personal checks are acceptable for advance rental amounts, balances and security deposit payments provided that the check clears the bank (30) days prior to check in. Otherwise, the payment must be in the form of certified or cashier’s check, money order, Visa, or MasterCard. A $25 service charge on all returned checks will be added to your balance. |
| 2. Cancellation: Your deposit is refundable if (a) there is at least a (30) day notice of cancellation and (b) the suite is re-rented for the same dates. Otherwise cancellation after confirmation of booking results in forfeiture of any collected money, except the guest's security deposit and cleaning fee (if applicable). Collected money is non-refundable unless the home becomes unfit for habitation. If a portion of the rental time is re-booked at the same rate, a pro-rata refund will be made. All refunds of rental services payments, whether complete or pro-rata, will be subject to a deduction equal to as much as 15% of deposit(s) paid. To protect against cancellations caused by certain unforeseen events, such as illness, we recommend that guests purchase travel insurance to assure refund of deposits paid. |
3. Occupancy: ALL PERSONS STAYING IN THE SUITE MUST BE REGISTERED AT THE TIME RESERVATIONS ARE MADE. This reservation is accepted for eight persons for the four bedroom rental, six persons for the 3 bedroom plan, and 3 persons for the studio unless disclosed to and agreed upon by the owner. Hale Naupaka will not be used in combination with other accommodations. This reservation is for quiet residential vacation accommodations only. Therefore, parties, weddings, receptions, luaus, events, and gatherings of any kind are strictly prohibited. No more than 2 additional people beyond the maximum occupancy of the house are allowed on the property at any one time, unless disclosed to and agreed upon by your host in writing. Only two vehicles may be parked on the property at any one time. Quiet hours are from 9:00 p.m. until 8:00 a.m. Guest use of property is subject to local noise ordinances, therefore loud amplified music is not allowed. Noise complaints are subject to local law enforcement intervention. Law enforcement intervention will be seen by Owner as a violation of this condition.
The property shall be in the same condition upon departure as at check-in, normal wear and tear excepted. Guest may cook only in areas specifically designated for cooking. Guest must immediately notify the Owner or Manager of fire or other damage to the property. Guest shall be liable for all acts of the family, invitees, employees, or other persons invited onto the property. Guest may not sublet or re-assign this rental agreement. Guest shall be responsible to return all keys upon departure.. Guest shall not bring any pets onto the property. Guest understands that Hawaii is a tropical climate in which insects, rodents and lizards unfortunately flourish. You will undoubtedly encounter these pests during your stay and understand that Owner will make our best effort to hold to an absolute minimum your interaction with these pests. Contact with a pest inside or outside of your rental is not reason for termination of this agreement nor a refund of your monies. Guest shall not permit any use of the spa or Jacuzzi by unsupervised children or other guests, and shall keep exterior spa lanai door open. Guest and other invitees shall use the spa and Jacuzzi at their own risk. Guest understands that there are certain risks inherent to persons and property located adjacent to the ocean. Guest acknowledges that the Owner would not rent this property unless the guest accepted these conditions. |
| 4. Security Deposit: A security deposit is required for the Home to cover damage, loss of items from the property, long distance telephone calls not billed to credit cards or a third party and /or excessive cleaning (as determined by housekeeping upon your departure). |
| 5. Phones: The Phones in the home are for your convenience. Please charge all long distance calls to a credit card or third party. If there are no damages or losses, the security deposit then becomes a telephone deposit and will be returned when any telephone bills have been received and reviewed. Therefore, deposits may be held for (30-45) days after departure. |
| 6. Charges: Total charges do not include lei greeting, baggage handling, daily maid service (unless noted), gratuities, long distance telephone charges, car rental, airfare, food, liquor, laundry, personal items, excessive cleaning upon departure (i.e. upholstery or rug shampooing, etc.). ALL RATES are quoted on a per night basis for no more guests than the maximum occupancy listed below. |
| 7. Check In: Except where noted, check in is after 3:00 p.m. CHECK OUT is required by 10:00 a.m. on the day of departure. Exceptions to these check-in and check-out times must be approved in writing by the owner of the rental. LATE CHECKOUTS WILL BE CHARGED THE EQUIVALENT OF 1/2 NIGHTS RENT. |
| 8. Waiver of Liability: Owner shall not be responsible or liable for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, caused or incurred whether arising in contract, or otherwise in law or equity as a result of rendering of the services or accommodations as described in this agreement or as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the services or accommodations arranged by owner. Additionally, Owner shall not be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise caused by reason of military actions, acts of God, or by any agents, employees, subcontractors, servants or services as provided or substituted. Owner in their sole and unfettered discretion reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services. Owner is not responsible for valuables left in rental properties or cars on property. Each guest agrees that he or she is voluntarily participating in any and all activities, risks, and use of the accommodations and the adjacent ocean and beach, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result. For the execution, interpretation and enforcement of these Policies, the parties expressly submit to the jurisdiction and laws of the State of Hawaii. |
| 9. Pets: NOT permitted in the Home or common areas. |
| 10. Utilities: Please turn off the air conditioner, all electrical appliances and lights when not in use and whenever you leave the suite. |
| 11. Laundry: You may use the washer and dryer in the second floor laundry room, or the one in the closest garage. We are not responsible for any clothing damage or articles left, lost or stolen. Read and follow machine instructions. |
| 12. No Smoking is allowed inside of the home. Smoking is permitted on lanais and outside where it does not offend other guests. Disposal of ashes and cigarette butts outside is the responsibility of the registered guest. No candles or fires of any kind are allowed within the suites. |
| 13. Barbecue and Briquettes are available for your convenience. Please clean up after yourself. Leave hot coals in barbeque for proper disposal. GRILLING ON THE LANAI DECK IS STRICTLY PROHIBITED. Please grill in the yard area only. |
| 14. Trash must be placed in a proper receptacle or in the pickup bin by the rear fence next to the garage. Guests are asked to maintain a neat and clean living area. |
| 15. Damage: Please report any inoperative equipment, damages, dangers or faults immediately. The registered guest is directly responsible for all negligent, accidental, intentional, or unintentional damage to the interior or exterior of the suite or to the common areas, caused by the guest, their family, or their guests, and will be charged for all repairs, replacement, and other related expenses and costs. Leaving the suite in an excessively dirty or sandy condition will result in an additional cleaning charge. Since no smoking is permitted in the Home, a $100 cleaning fee will be charged if smoke is detected in the Home upon departure. |
| PLEASE NOTE: AS A REMEDY FOR VIOLATION OF ANY OF THE STATED CONDITIONS OF RENTAL IN THIS AGREEMENT, OWNER HAS THE RIGHT, BUT IS NOT LIMITED TO, TERMINATE THIS AGREEMENT AND EVICT THE TENANT WITHOUT ANY REFUND OF COLLECTED MONEY AND KEEP ALL OR A PORTION OF THE SECURITY DEPOSIT LIABILITY |
